In a meeting on 26 June 2018, the Supervisory Board agreed the deadlines for the pay-outs resp. reverse payments in the course of the publisher participation and ZPÜ back payments for the years 2011 through to 2016 (01/11/2018) as well as the distribution of YouTube revenues for the years 2009 through to 2016 (01/12/2018).
What are the next steps? We have outlined a list of all the important upcoming deadlines below.
By 16 October 2018: Provision of detailed schedules 1, 4 and 5
The detailed statements pursuant to the distribution plan, Art. 58 items 1, 4, 5 (previously individual statements) shall be made available via GEMA Download. More specific information on detailed statements 1, 4 and 5 can be accessed in the section “supporting documents”.
By 31 October 2018: Provision of specific “detailed reversal statements”
The detailed reversal statement was specifically developed for reversals of publisher participation and lists all adjustments per author / publisher on a per-work basis in CSV format. The detailed reversal statement shall be made available via our GEMA Download service. More specific information on the detailed reversal statement can be accessed in the section “supporting documents”.
1. November 2018: Pay-outs / clawbacks of publisher participations and pay-out of ZPÜ back payments
In order to implement the legal consequences of the Berlin Kammergericht (Higher Regional Court in Berlin) judgement (judgement of 14.11.2016) GEMA has conducted an electronic confirmation process, which allows publishers to prove their entitlement to payouts for the period from 1. July 2012 until 24. December 2016. On 1. November 2018 the final adjustments resulting from the EPC will take place. Publishers, who are unable to prove their entitlements, will be charged. The corresponding sums will be credited to the authors. Likewise on 1. November 2018 the distribution of exceptional revenues from the Central Organisation for Private Copying Right (ZPÜ) for Mobile Phones and Tablets for the years 2011 to 2016 will take place. 1. December 2018: Distribution of YouTube back payments
The payout of income from a settlement agreed with Internet platform YouTube in 2016 will take place on 1. December 2018. Detailed information on the statements, which will be sent by GEMA on 1. December 2018 can be found in the section “Supporting Information”.
