
GEMA WINS AGAINST OPEN AI
In Europe’s first landmark AI ruling, the Munich Regional Court ruled in November 2025 that OpenAI had infringed applicable copyright law through the training and operation of ChatGPT. GEMA had filed a lawsuit against the use of nine well-known song lyrics. The court concluded that OpenAI should have acquired the rights to the song lyrics. The ruling is considered a milestone for all creators. It could have implications far beyond song lyrics.
CRITICISM OF THE IMPLEMENTATION PACKAGE FOR THE AI ACT
We are tirelessly committed to defending copyright and the interests of music creators. As part of a broad coalition of associations representing the cultural and creative industries, we criticized the European Commission’s implementation package for the AI Act in the summer of 2025. In our view, the package does not meet its stated objectives. It fails to create transparency, and many AI tools are not covered at all. Furthermore, it does not provide incentives or impose binding obligations on AI companies to engage with creators and their partners.
