Radio and Television

On 1 July 2022, GEMA will distribute over EUR 228m in royalty revenue to its members and sister organisations in the television and radio distribution categories.

Compared to last year, royalty income from broadcasting has increased significantly. The same holds true for royalty income from what is known as “communication to the public” (e.g. music played back at shops or restaurants), which has also increased again and part of which is incorporated into the distribution sums for the broadcasting right distribution categories. The total increase the broadcasting categories have seen since last year is approx. 9 %. However, the degree to which this is reflected in your specific distribution payment depends on the particular contexts in which your works are used (e.g. on the length of their use or the radio station or TV channel broadcasting them).

It has now been three years that GEMA has made this distribution for music use by public service broadcasters on the basis of reports created by radio stations and TV channels using monitoring technology.

Cinema

Royalty income in this category has increased compared to last year, resulting in an increase of the distribution sum by 21%. However, as is generally known, cinemas had to remain closed for most of 2021 and, as a consequence, the level of the distribution sum is still strongly affected by the effects of the pandemic in comparison to previous years.

Phono VR, BT VR

Audio and Audio-Visual Media

The distribution sum in the audio and audio-visual media categories
(Phono VR, BT VR) has decreased over last year. However, vinyl continues to enjoy great popularity, resulting in another significant increase this year.

Since the beginning of this year, GEMA has been in some cases unable to issue invoices for licences in physical audio media due to a necessary change in its system. Therefore, the distributions for those media are not included in the current distribution in categories Phono VR and BT VR but are expected to be included in the distribution sum as at 1 January 2023 (which will be distributed before the end of the year).

Special regulations including two distributions, on 1 June and 1 July 2022

Due to the COVID-19 pandemic, many live events had to be cancelled in 2021, which has an effect on the distribution in the M category, just like in the year before. As a consequence, the General Assembly decided last year that the distribution in the M category should be adapted for the 2021 financial year:

Distribution in two steps:

Stage 1:

As of 1 June 2022, the usual M distribution will take place on the basis of the (relatively few) live performances in 2021. Deviating from previous processes, no new point value will be calculated in the segment sectors 1 to 8. Instead, the average point value of the M category of the last three financial years (2017 to 2019, before the pandemic started) will be used as a basis. The 20 % supplement for the M category in the segment sectors 9 to 12 (from collections of € 500.01 and more) remains unchanged.

Stage 2:

As of 1 July 2022, the remaining balance of the distributable amount in the M category for the 2021 financial year will be distributed as a percentage-based supplement in the M category for the 2018 to 2020 financial years (M-Zuschlag Corona/Corona M supplement).
You will find the specific amount of payment in your account statement, which you will receive as of 1 July 2022.

Further information

Fortunately, concert operations are currently running largely without restrictions. Netherthless the General Assembly adopted the respective roll-over of this regulation for the 2022 financial year a few days ago. (Agenda MGV 2022 - Request 22, p. 50-52).

International

In the International Music Use categories A and A VR (International Mechanical Right), we distribute the royalties generated by our sister organisations for use of the GEMA repertoire in their respective countries. Royalties for the use of GEMA members’ works in foreign countries are distributed with a certain time lag. That’s why the effects the COVID-19 pandemic has had on the use of music in 2020 and 2021 are noticeable in this distribution sum.
