All important information on distributions in the categories: Live and communication to the public

As of 1 June and 1 July 2022, we will pay out about 52 million euros to our members and sister organisations. The 2021 financial year marked the second pandemic year in a row and was characterised by a large-scale wave of cancellations, especially of live events. Again, revenues in this licensing sector suffered a great loss. The distributable amount is correspondingly low, a painful experience for many GEMA members.


Due to the fact that the majority of hospitality and retail venues are open again, the communication to the public sector is fortunately showing significant growth once more and the corresponding turnover figures are already approaching pre-pandemic revenues.

Compared to the previous year, a slight plus of about 4% of the distributable amount of the previous year will be reached across all live and communication to the public categories; overall, the results are still far from pre-COVID-19 levels. The effects in each of the categories and at individual level for the relevant rightsholders therefore turn out rather differently.

Playback / Communication to the public (Category M) - special regulations due to COVID-19 including two distributions, on 1 June and 1 July 2022

Due to the COVID-19 pandemic, many live events had to be cancelled in 2021, which has an effect on the distribution in the M category, just like in the year before. As a consequence, the General Assembly decided last year that the distribution in the M category should be adapted for the 2021 financial year:

Distribution in two steps:
Stage 1

As of 1 June 2022, the usual M distribution will take place on the basis of the (relatively few) live performances in 2021. Deviating from previous processes, no new point value will be calculated in the segment sectors 1 to 8. Instead, the average point value of the M category of the last three financial years before pandemic starts (2017 to 2019) will be used as a basis. The 20% supplement for the M category in the segment sectors 9 to 12 (from collections of €500.01 and more) remains unchanged.

Stage 2

As of 1 July 2022, the remaining balance of the distributable amount in the M category for the 2021 financial year will be distributed as a percentage-based supplement in the M category for the 2018 to 2020 financial years (“M-Zuschlag Corona” / “Corona M supplement”). You will find the specific amount of payment in your account statement, which you will receive as of 1 July 2022.

Nethertheless the General Assembly adopted adopted the respective roll-over of this regulation for the 2022 financial year a few days ago (Agenda MGV 2022 - Request 22, p. 50-52). 

Discotheques - mechanical performances (Categories DK & DK VR)

Due to the closures of clubs and discotheques as a consequence of the pandemic in Germany since mid-March, monitoring was only carried out for a few months in 2020 and 2021. Nevertheless, it was possible to apply the usual process regarding the planned statistical projection method for these periods. The amounts generated in the 2021 financial year also partially relate to the 2020 usage year. As a consequence, the monitoring results available for 2020 and 2021 form a valid and representative basis for the distribution in the DK and DK VR categories.

You can submit a claim for an incorrect distribution quickly and easily using the following options:

  • You log in to the Online Portal and use the Service Claims.
  • For missing live events, use the service My setlists in the Online Portal where you can submit your setlists in the form of a complaint/claim.

Please note: Before submitting any claims, please check whether a distribution has already been made for the period and category. You can access an overview of the deadlines and categories here: Please only claim uses, which are not included in your detailed statements (on the Online Portal > GEMA Download) or need to be claimed for other reasons. Pursuant to § 59 of the GEMA distribution plan, claims must contain specific details which permit a verification. You ensure that this is the case by providing the requested details in the Online Portal under Claims. You can access all the details regarding claims here.

You do not have access to the Online Portal yet? Register as a music creator here. Then, you will receive an e-mail with an activation link to set your own password. After that, you complete the activation application which is shown in the Online Portal, and send it through to us. Once your account has been successfully activated, we will inform you. It is possible that the account statements are still on their way, they are only available a few days after the pay-out at the start of the new month. The process is as follows:

  1. Detailed breakdowns/statements are available via the GEMA Download.
  2. Money flows.
  3. The account statement will be issued and transferred (by post or the Online Portal)

It is not possible to provide a generic answer to this question. It depends on the distribution category, the performance context and the level of the licensing fee which the event organisers pay to GEMA. Here you can find further details.

The COVID-19 financial aids will be offset as follows, but no earlier than: GEMA Schutzschirm 2020 from 1 June 2023; GEMA Schutzschirm 2021 from 1 June 2024.
